Today, Hyderabad: The Telangana High Court has put an end to the dispute over the distribution of shares of the heirs of Nawab Fakhrul Mulk, which has been going on for more than half a century. A sensational verdict has been issued solving the case that has been going on for 73 years. The Berhampur Bank case, which is one of the oldest cases in the country for 72 years, was resolved last year by the Calcutta High Court, while the Telangana High Court recently resolved a 73-year-old case and entered the pages of history. A bench comprising Chief Justice Alok Aradhe and Justice NV Shravankumar has recently delivered its verdict on the dispute between the heirs of Nawab Fakhrul Mulk.

This is the controversy

A preliminary decree was passed in 1951 through three conciliation petitions in the High Court in a dispute over the distribution of inherited land belonging to Nawab Fakhrul Mulk. Accordingly, 9 properties in the city should be distributed to five people in five parts. They are located in Erramanzil, Erragadda, Bollar, Balda, Behlulkhanguda, Yusafguda, Musapet. So far 9 receivers have been appointed to protect the lands and sell them and distribute the shares. Since then, disputes and cases have been going on in order to distribute each property. Some property was also distributed among the heirs. The government also collected some land and gave compensation and distributed it to the heirs. In that order, 59 acres belonging to Erram Numa bungalow in Erragadda was collected and a government TB hospital was built. And as the matter of transfer of property has been an ongoing dispute, on 29 November 2022, the High Court has issued an order appointing the retired District Judge Mohammad Nizamuddin as the last Receiver Comm Commissioner. He submitted the final report to the court on March 16 last year. The High Court has issued a notice to the Bar Association that they can raise objections to the report. Some objected.

Nothing is left except the graveyard

A bench comprising Chief Justice Justice Alok Aradhe and Justice NV Sravankumar approved the report submitted by the receiver. In fact, the tribunal rejected the objections raised by some that there were still lands that could not be distributed even though the receiver’s report stated that there was nothing to be distributed at the field level except for the cremation ground in Ameerpet. Objections cannot be entertained without furnishing specific details while claiming that land is available. “After all these years, it cannot be said that there is still a new reason for distribution of part,” the court clarified.

Those who do not take claim can take money

The bench ordered the registry to make a fixed deposit of Rs.1,18,81,249 with the High Court as on March 10, 2023 from the sale of the land. The judgment said that those who have not claimed their share can file a check petition and take the money with interest. Since the center has recognized the crematorium in Ameerpet as a historical site, the heirs of Mulk should form a committee to preserve it, and the sentencing could not take place, the verdict said. The bench appreciated the High Court Registry for preserving 73 years of records related to this case.

Three more old cases are pending

Three other old cases related to Nizam Nawabs and more lands are pending in Telangana High Court. Many big people are going to the Supreme Court by filing petitions on interim petitions claiming that they have purchased from heirs with power of attorney and have rights over them. A bench comprising Chief Justice Alok Aradhe and Justice N.V. Shravankumar is conducting the hearing with the aim of disposing of the interim petitions as disputes are increasing while the original petition is pending.
