Shimla. The Himachal Pradesh High Court canceled the transfer orders issued arbitrarily. The division bench of Justice Tarlok Singh Chauhan and Justice Virender Singh found that the applicant Dr. Richa Salwan was transferred for the purpose of accommodating Dr. Ranjana Sharma, who was made a private respondent. According to the facts given in the petition, the applicant was posted in the College of Horticulture and Forestry Neri District Hamirpur on November 5, 2018, after being appointed as Assistant Professor Microbiology and his services were terminated on January 1, 2022. regularized. The defendant University issued appointment letters to the defendants Dr. Ranjana Sharma and Dr. Shivani Chauhan on contract basis in the year 2021. The respondent Dr. Ranjana Sharma was posted against a vacant post in the College of Horticulture and Forestry, Thunag, District Mandi. But he worked in Thunag only for 4 months.

After that, on January 1, 2022, he was sent on deputation to the Department of Basic Science University’s main campus, Nauni. This deputation was only for 2 months but she continued to serve in Nauni even after 2 months. The second respondent Dr. Shivani Chauhan who was appointed on contract basis only in 2021 was posted in Basic Science Dr. Yashwant Parmar University Nauni District Solan. As per the transfer order issued on October 11, 2022, the applicant was transferred from College of Horticulture and Forestry Neri district Hamirpur to College of Horticulture and Forestry Thunag district Mandi while Dr. Ranjana Sharma was transferred from College of Horticulture and Forestry Thunag district Mandi to Dept. of Basic Science was transferred to Dr. YS Parmar University Nauni and Dr. Shivani Chauhan was transferred from Department of Basic Science Dr. Yashwant Singh Parmar University Nauni to College of Horticulture and Forestry Neri District Hamirpur. The Court observed that this transfer order was made only for the purpose of adjusting the respondent Dr. Ranjana Sharma who was working on deputation to Dr. YS Parmar University and was drawing her salary from College of Horticulture and Forestry Thunag. Finding the transfer orders wrong, the court quashed the transfer orders issued on October 11, 2022.
