Political stir has started after the Allahabad High Court canceled the notification of the state government to keep 18 backward castes of Uttar Pradesh in the category of Scheduled Castes (SC). The main opposition party of the state, Samajwadi Party (SP) has expressed its intention to fight for the rights of these 18 backward castes, while the Congress has accused the ruling Bharatiya Janata Party (BJP) of cheating them by taking votes of these castes. .

BJP’s ally Nishad Party has welcomed the court’s order, saying that the state government’s earlier notifications to include 18 backward castes in the Scheduled Castes were erroneous and “unconstitutional”. However, the Nishad Party, which represents the Nishad community, has clarified that it will continue to fight over the matter. From the stand of Nishad Pair, it seems that he still hopes that BJP will do something in this direction.

It is noteworthy that the Chief Justice of Allahabad High Court, Justice Rajesh Bindal and Justice J. J. Munir had quashed the petition challenging the notifications issued by the state government in 2016 and 2019 for inclusion of 18 backward castes in the category of Scheduled Castes.
The then Akhilesh Yadav government in the state in 2016 and the Yogi Adityanath-led BJP government in the year 2019 had issued notifications related to the inclusion of 18 backward castes in the category of Scheduled Castes, but their implementation was stayed by the court.

Most of the results depend on their votes.

Even before this, the SP government led by SP founder Mulayam Singh Yadav had tried to include these backward castes in the Scheduled Caste category by issuing an order in 2005, but that too was stayed by the High Court. Two years later, the BSP government of Mayawati canceled this order. However, later Mayawati wrote a letter to the Center giving her support for the inclusion of some of these castes in the category of Scheduled. Majhwar, Kahar, Kashyap, Kewat, Mallah, Nishad, Kumhar, Prajapati, Dhivar, Bind, Bhar, Rajbhar, Dhiman, Batham, Turha, Godiya, Manjhi and Machchua castes constitute the total number of OBCs in the state. It is about 50 per cent of the population and the outcome of most of the 80 Lok Sabha seats in Uttar Pradesh depends on their votes.

Political parties are preparing for the 2024 Lok Sabha elections. In such a situation, the political stand of these castes can matter a lot. The Samajwadi Party, which usually has a base in the Yadav fraternity, is now keen to expand its influence among the OBC voters. For this, it has forged an alliance with smaller caste-centric parties- Apna Dal (Kamarawadi), Mahan Dal and People’s Party.

At the same time, the ruling BJP has been working on securing the support of non-Yadav OBC castes in Uttar Pradesh since the 2017 assembly elections. Apna Dal (Sonelal) and Nishad Party are now allies of BJP in Uttar Pradesh. The opposition parties have made their intention clear that they will use this case of 18 backward castes against the ruling BJP in the next Lok Sabha elections.

SP leader Rajpal Kashyap indirectly alleged that the BJP government was behind the petition on which the Allahabad High Court quashed the notifications to include these 18 castes in the Scheduled Castes. Yogi Adityanath government is snatching the rights of other backward class people. He said, “Our leader Akhilesh Yadav had issued a notification to include 18 castes in the Scheduled Castes after much discussion in 2016. BJP made a promise for these castes but did not fulfill it. This is a complete betrayal of these most backward castes.”

Kashyap said, “Where are those BJP leaders and their allies, who do politics of backward castes? The BJP government needs to answer for its anti-backward move.” Congress also attacked the BJP, claiming that the ruling party has betrayed these 18 backward castes. Congress spokesperson Anshu Awasthi said on this issue that the order of the High Court has made it clear that the Bharatiya Janata Party (BJP) has assured the people of these 18 castes to be included in the Scheduled Castes to take votes in the elections. They cheated after taking votes.

A “Technical Fault” in the State Government’s Canceled Order

He said that there is a BJP government in Uttar Pradesh as well as at the Centre, if this party (BJP) was really friendly to these 18 castes, it could have constitutionalized the process of including them in the Scheduled Castes by bringing a law in Parliament. He has cheated them once again by not doing so. Nishad Party chief Sanjay Nishad said there was a “technical flaw” in the state government’s canceled order. He said, “We will continue to fight for the reservation of Majhwar under which seven castes including Nishad, Kewat, Mallah and Bind come and will launch a signature campaign in this regard. We will also meet Chief Minister Yogi Adityanath and Union Home Minister Amit Shah in this regard.”
