On what basis did the High Court decide the finality of the case even before the charge sheet was filed when the trial itself was not yet complete? Why is the High Court in such a hurry when there is no place in the law itself to declare this? is a puzzling mystery.

Generally if bail is granted by the accused in a case, if the persons concerned are released on bail, does it affect the trial of the case? Are evidences and documents likely to be destroyed by them? Will going out on bail threaten or threaten the victims? Will the accused fully cooperate with the investigation? Decisions related to bail are taken by the courts on the basis of various factors. This is what the Supreme Court has laid down as the guidelines to be followed for taking decisions related to bail.

The Supreme Court has clarified these in the judgment of Samanlal v. Government of Uttar Pradesh in 2004. Otherwise, contrary to the rule that all the merits of the case should not be announced, the High Court has said that all the accused are innocent and that the death of the student was a suicide, which is a blatant violation of the judicial system.

Along with this, there is a possibility that the management of the school, who are known to have a lot of influence and political background, coming out on bail may hinder the investigation.

Therefore, on behalf of the Tamil Nadu Party, we urge the Government of Tamil Nadu to act proactively in this matter and immediately appeal to the Supreme Court against the bail granted by the High Court to the accused in the death case of Smt.
