The story started from 2014

In the year 2014, BJP was not only in power, elections were also held in Jammu and Kashmir. In that election, PDP got 28 seats, BJP 25, NC 15 and Congress 12 seats. No one had majority, Farooq’s party was not ready to go with Mehbooba. In such a situation, confusion persisted for several days. No one knew what the future of Jammu and Kashmir was going to be. The thing to understand here is that in the resolution letter of BJP, it was written that Article 370 has to be abolished. It was difficult to do this because its government was never formed in Jammu and Kashmir.

But in the year 2014, this opportunity came to BJP. At that time the government was not mentioning it openly, but the discussion was intense inside. The first priority was to somehow form a government in Jammu and Kashmir. BJP agrees to join hands with PDP to form government. After several rounds of talks in the month of March, an alliance was formed in Jammu and Kashmir which no one had imagined. Mufti Mohammad Sayeed was made the CM and Nirmal Kumar Singh from BJP was made the Deputy CM.

Now BJP’s resolution is to abolish Article 370, PDP’s resolution is to talk to Pakistan for peace and also establish dialogue with separatists. That is to say, both the parties made a common minimum program, but problems continued from the beginning. There was no consensus on any issue. Mehbooba wanted ceasefire in the month of Ramzan, BJP was not ready. Still it was implemented and terrorist incidents increased. BJP wanted to remove 370, PDP was trying to save it at any cost. PDP wanted to have mercy on the stone pelters, BJP was demanding more strict action.

Death of Burhan Wani and outline of 370

On top of all this, on July 8, 2016, Hizbul commander Burhan Wani was killed. BJP sees Kashmiri youth as terrorists, PDP sees Kashmiri youth and this difference of opinion set the valley on fire. The violence continued for seven months, curfew was imposed and 84 people died. After the militancy of 1990, Kashmir again witnessed a terrible period of violence. That is, not only did this alliance do something for the welfare of Kashmir, but that one dilemma had made the situation in Kashmir more tense.

This was the time when the distance between BJP and PDP had increased further, there was no other option left than separation. In such a situation, after 40 months, on 19 June 2018, BJP withdrew its support from PDP and the government fell. Now it is important to understand this event from the perspective of Article 370. At that time, only selected reasons were being discussed in the media, but Article 370 was also a major reason for the break of the alliance.

Alliance broke with Mehbooba, government’s intentions revealed

BJP had understood that if it remained in alliance with PDP, its real resolve would never have been fulfilled. Experts believe that the breakup of the alliance was a major turning point in the abolition of Article 370. This is because Governor’s rule was imposed after the alliance ended. Satyapal Malik was made the Governor and he assumed his post on 23 August. Now the thing to be understood was that Governor’s Rule could not be extended more than 6 months, hence on December 19, 2018, it was abolished and President’s rule was imposed in Jammu and Kashmir.

Failure of fax machine and President’s rule

Now one thing has to be understood, before the imposition of President’s rule, Satyapal Malik had done a great work. On his behalf, the Jammu and Kashmir Assembly was dissolved on 21 November. The thing to be noted here is that PDP and NC wanted to form the government together, everything was finalized, it was just a game. The fax machine of the Governor’s office broke down and letters from both the parties did not reach the Governor. Now, there are different opinions regarding this fax machine scandal. Mehbooba Mufti and Omar Abdullah consider this to be part of a bigger conspiracy so that the government cannot be formed.

On the other hand, if we look at the strategy of Modi government, if PDP-NC government was formed then the resolve to abolish Article 370 would not have been fulfilled. For this reason, some people believe that as part of a larger strategy, Satyapal Malik deliberately got the assembly dissolved and later President’s rule was imposed. This was the time when Lok Sabha elections were near and the government was confident that it would return to power. In such a situation, internal preparations were started for that big mission.

Licking the legal books and the biggest trick

Emphasis was being laid on how to abolish Article 370. The minds of many officers were focused on this. All the law books were being read, the focus was on giving a safe and sound verdict at all costs. Now this happened because after returning to power, Modi government made abolishing Article 370 its priority. On one hand, there were frequent visits of senior officials and leaders to Kashmir, on the other hand, steps were also taken to strengthen the security there.

Increasing security forces and ‘misguided politics’ in the valley

After some time, the deployment of security forces suddenly started increasing in the valley. At that time, because there was a situation of tension with Pakistan, everyone felt that all these preparations were being made to deal with the neighbour. But the real reason was what came before the entire country on August 5, 2019. Now the government put a lot of thought into abolishing 370, talked to many legal experts, even the Law Ministry brainstormed for hours, only then this big decision was taken by making some changes.

Now if we try to understand carefully, an order from the President came on 5th August. An amendment was made in that order regarding Jammu and Kashmir. Under that amendment, what till now in Jammu and Kashmir we were considering as Constituent Assembly, was changed to the status of Legislative Assembly. On top of this it was also said that the government of the state would be equivalent to that of the Governor. Now there was a big game here too, it can be said that this change was made deliberately.

How the law changed and history was created?

Actually, President’s rule was imposed in Jammu and Kashmir, in such a situation the question was from whom would the Governor take the opinion, there was no government there at that time. In a normal situation, the opinion of the Legislature would have to be accepted, but in that situation all the power came back to the Central Government and the President. For this reason, the President said in an order that all the provisions of the Indian Constitution will be applicable to Jammu and Kashmir. In this way Article 370 was abrogated without being abolished. Along with this, the provisions of 35A also became inoperative.
